A BILL to amend article six, chapter thirty-three of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated
section
thirty-one-f, relating to exempting excess or umbrella
policies of insurance from having to offer, provide or make
available uninsured and underinsured motorist coverage.
Be it enacted by the Legislature of West Virginia:
That article six, chapter thirty-three of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended
by adding thereto a new section, designated section
thirty-one-f, to read as follows:
ARTICLE 6. THE INSURANCE POLICY.
§33-6-31f. Uninsured and underinsured motorists' coverage not
required to be offered on umbrella or excess policies, or on policies not written to cover a
specifically insured motor vehicle.



Insurers issuing or providing liability policies that are of
an excess or umbrella type, or that include excess or umbrella
coverages, or which are not written to cover a specifically insured
motor vehicle, are not required to offer, make available, or
provide uninsured or underinsured motor vehicle coverage on such
policies, notwithstanding any other provisions of this article.



NOTE: The purpose of this bill is to exempt umbrella and
excess insurance policies, and policies not written to cover a
specifically insured motor vehicle, from having to offer, provide
or make available uninsured and underinsured motorist coverage.
